General terms and conditions of sale

 Article 1 - Presentation

These General Terms and Conditions of Sale (GTCS) govern the contractual relationship between:

• any individual customer (consumer) making a purchase via the website cristalandcie.com 
• any professional customer (natural or legal person acting within the scope of their professional activity) making a purchase via cristalandcie.com. 
The validation of an order implies unreserved acceptance of these GTCS. The professional customer acknowledges having the necessary legal capacity to enter into a contract. 
 
Article 2 - Products Offered 
 
Each item is second-hand and is described on its dedicated page (manufacturer, model, material, dimensions, condition, weight). The photos are contractual. 
The customer is informed that the items sold are second-hand items whose condition is that observed and described by the seller at the time they were put online. Normal wear and tear related to the age and use of an antique or second-hand item as well as minor manufacturing defetcs do not constitute a lack of conformity. 
 
Article 3 - Account Creation 
 
Any order placed on the cristalandcie.com website is subject to the creation of an account. You must have a valid email address. 
 
Article 4 - Prices 
 
Prices are expressed in euros, all taxes included. Delivery costs are specified after choosing the destination country and before validating the order. Prices may be modified at any time; the applicable price is the one displayed at the time of the order. 
Prices in US dollars are given for information purposes only. 
 
Article 5 - Ordering 
 
Ordering is done online via the website. The customer must: 
-Select the item and add it to the basket; 
-Check the order summary; 
-Accept these GTCS (checkbox); 
-Proceed to payment. 
The sales contract is formed at the time the order is confirmed by the seller (confirmation email). 
It is the buyer's responsibility to inquire in advance about any potential customs duties and to pay them to the relevant authorities. 
 
Article 6 - Reservation 
 
In the event of an item reservation, the buyer has 4 working days to make payment. Failing this, the item will be put back on sale. 
 
Article 7 - Shipping Costs 
 
Shipping costs are calculated according to the chosen delivery address. 
When creating your account, if your country is not in the list, please contact me. 
 
Article 8 - Payment 
 
Orders are paid for: 
      -either by check (France only) 
      -or by Paypal (A fee of 3% plus 35 cents per order will be charged for this payment method.) 
      -or by bank transfer 
      -or by credit card (CB, MasterCard, Visa, American Express) 
      Payment Security and Anti-Fraud Controls 
      Your purchases on https://www.cristalandcie.com/ are 100% secure thanks to the implementation of payment control and security systems. It is important to know that payment for your order by credit card is made directly with our partner bank: Crédit Agricole. Providing your credit card number on the banking server at the time of payment for your order is entirely secure. Indeed, this operation carries no risk because your credit card details never transit in plain text over the network: they are encrypted using the SSL (Secure Layer) protocol. CristalAndCie does not have access to your bank details and does not store them on its servers under any circumstances. This is precisely why they are requested again for each new transaction on our site. Providing your credit card number on our site is entirely secure. On the other hand, it is possible that a malicious person may manage to obtain your credit card number (for example in the event of theft) and use it to place an order without your knowledge. 
       
Article 9 - Delivery 
 
Items are shipped within two working days following receipt of payment. 
Shipping is carried out via Colissimo registered or Mondial Relay with insurance selected according to the order amount. Another carrier may be used if necessary. For delivery times, please refer directly to the carrier's website. 
Any delivery delay must be attributed to the carrier and therefore cannot give rise to the cancellation or refund of an order. 
In the event that the buyer fails to collect the package from the pickup point, no refund will be issued. 
 
Article 10 - Claims 
 
In the event of items damaged during transport, the buyer must issue all necessary reservations with the carrier upon receipt of the package, and confirm these reservations to the seller in writing within 5 working days. 
 
Article 11 - Right of withdrawal 
 
Consumer Customer: 
In accordance with Article L.221-18 of the French Consumer Code, the consumer customer has a period of 14 days from receipt of the item to exercise their right of withdrawal, without having to justify any reasons. 
 
Conditions: 
The item must be returned in its original condition, in its original packaging, with no trace of use. 
The customer must contact the seller at contact@cristalandcie.com before shipping the return and provide the tracking number.

Return shipping costs are the responsibility of the customer. 
The refund is made within 14 days after receipt of the returned item. 
Except in special cases, the refund will be made using the same means of payment selected by the buyer at the time of purchase. 
 
Professional Customer: 
The professional customer does not benefit from the right of withdrawal provided for by Article L.221-1 of the French Consumer Code. Any order placed by a professional is firm and final. 
 
Article 12 - Consumer mediation 
 
In accordance with Articles L.611-1 and following of the Consumer Code, the consumer customer has the option of using a consumer mediator free of charge for the amicable resolution of a dispute between them and the professional.

Referral Conditions: 
The consumer customer must first contact the seller in writing (email or mail) to attempt an amicable resolution. 
In the absence of a satisfactory response within a period of 2 months, the customer may refer the matter to the mediator. 
Referral can be made online at www.cm2c.net, by email, or by mail. 
Mediation is free for the consumer. 
Professional customer: the option of consumer mediation is not applicable. 
 
Article 13 - Personal Data 
 
The data collected (identity, contact details, order history) are processed in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act (Loi Informatique et Libertés). They are not transferred to third parties other than carriers and payment service providers. The customer has a right of access, rectification, and deletion by writing to contact@cristalandcie.com. 
 
Article 14 - Applicable Law and Jurisdiction 
 
These GTCS are governed by French law. 
In the event of a dispute with a consumer: exclusive jurisdiction of the courts of the consumer's place of residence (Art. L.284-1 C. cons.). 
In the event of a dispute with a professional: exclusive jurisdiction of the Commercial Court of Clermont-Ferrand, even in the event of multiple defendants or third-party claims. 
 
Article 15 - Modification of GTCS 
 
The seller reserves the right to modify these GTCS at any time. The GTCS applicable to an order are those in force on the date of the order.
